We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.

We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway provider’s database, to be accessible only by those authorized with special access rights to such systems. Our provider is required to keep the information confidential.

Do we disclose any information to outside parties?

Except as disclosed in this Privacy Policy, we do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. We may disclose your personal information to trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

We may also release your information when necessary to comply with applicable law or to enforce our site policies.

Thank you for choosing SECURAM Smart Home.

THESE TERMS OF SERVICE ARE A LEGALLY BINDING AGREEMENT BETWEEN THE PURCHASER AND/OR USER OF ANY SECURAM TECHNOLOGY ("YOU") AND SECURAM SYSTEMS, INC. AND ITS SUBSIDIARIES AND AFFILIATES OR PARTNERS ("SECURAM" OR "US" OR "WE" OR "OUR"). BY CLICKING "I AGREE," YOU ARE AGREEING TO THESE TERMS.These Terms of Service apply to the SECURAM Smart Home app and to the SECURAM Website (www.securamsmart.com) and all other SECURAM Devices, Licensed Software, and SECURAM Services.

Before using the SECURAM Smart Home app, please read these Terms carefully and make sure you fully understand them. You will not be authorized to register, login to or use any products or services covered by these Terms, unless you agree to accept the Terms. Please retain a copy of these Terms for reference. You may not enter into this agreement or use our products or services if you are prohibited by applicable law from doing so.

These Terms apply to you and anyone you authorize to use the SECURAM Technology. You are obligated to ensure that anyone you authorize to use the SECURAM Technology also abides by these terms.

1. Definitions

"Licensed Software" refers to all software you obtain from SECURAM in connection with your use of our products or services, including the Smart Home application.

"SECURAM Devices" refers to those SECURAM Smart Home devices purchased from us or our partners or other channels authorized by us.

"SECURAM Services" refers to all services provided by or through the use of the SECURAM Website or Licensed Software.

"SECURAM Website" refers to our website (www.securamsmart.com) and any other website operated by us.

"SECURAM Technology" refers to the Licensed Software, the SECURAM Devices, the SECURAM Services, and the SECURAM Website, collectively and individually as the context indicates. SECURAM reserves the right to add, change or remove the SECURAM Technology, in whole or in part, without additional notice.

2. Registration and Passwords

Before using the SECURAM Services, you must create a user account. During registration, SECURAM may ask you for certain personal information. This information should be complete and correct and should be updated after any changes. SECURAM values your privacy and will use your information only as described in the SECURAM Smart Home Privacy Policy (SECURAM Privacy Policy).

You are responsible for maintaining the confidentiality of the login name and password that you create. You agree to use strong passwords (e.g. that contain upper and lower case letters, numbers and symbols) and to renew your password periodically.

You are responsible for all uses of your login information and account, whether or not authorized by you. You must notify us of any unauthorized use of your account, and you must immediately change your password in that event to prevent further unauthorized use.

We may use the contact information that you submit to provide you with notices and promotional offers as set forth in our SECURAM Privacy Policy.

3. Right to Use the SECURAM Technology

SECURAM grants you a non-transferable, non-exclusive right (without the right to sublicense) as set forth in these Terms to:

A.Use the Licensed Software, SECURAM Services and SECURAM Website in connection with, and solely for the purpose of, controlling and monitoring the SECURAM Devices installed on your property, or that you have been validly authorized to access, or to otherwise access a service provided by SECURAM for your authorized use; and

B. Install and use the Licensed Software solely on your own handheld mobile devices (e.g.,smartphone, tablet, watch) and solely for the purposes set forth in A. above.

Unless otherwise stated in these Terms, you may use the SECURAM Technology solely for your personal and non-commercial use. You may not reproduce, repackage, sell or resell the Licensed Software, SECURAM Services or SECURAM Website, or any part thereof. If you transfer SECURAM Devices to a new owner, please note that your account is not transferable; the new owner will have to register a separate account in order to use the SECURAM Services.

You agree to comply with all instructions, usage rules and documentation that we may provide from time to time with respect to the SECURAM Technology.

In addition, we may from time to time update the Licensed Software, SECURAM Services, and SECURAM Website, including without limitation, by providing bug fixes, new functionality or modifications. Please note that these may occur automatically without additional notice. Your continued use of the SECURAM Technology constitutes your ongoing consent to these updates. We may also ask you to install updates yourself, and you agree to do so promptly. Failure to install these updates may expose you to security risks, limit our ability to provide the SECURAM Services to you, and otherwise limit the effective functioning of the SECURAM Technology. Updates are subject to these Terms together with any additional terms that may be provided with them. Your continued use of the SECURAM Technology constitutes your agreement to those additional terms.

Certain functions of the SECURAM Technology may require use of your Internet service provider's and mobile service provider's facilities. SECURAM is not responsible for the performance of or any charges for these facilities. We may advise you to upgrade those services to improve your user experience, reliability, or speed, but we are not obligated to do so.

4. Intellectual Property

The content displayed in connection with the SECURAM Technology, including but not limited to text, data, graphics, images, video, and audio, may be protected by copyright, trademark or other law relating to intellectual property. Use of the Services does not give you any rights to that content, other than as permitted in these Terms.

5. Third-party Websites, Devices and Services

The SECURAM Technology may provide you with contact information for or make use of products and services from third parties and may include links to third-party websites, products and services, such as locksmith services. Any such products, services and links are provided solely as a convenience to you. By accessing or using these third-party products and services, you are agreeing to use those products and services in accordance with their terms. We do not guarantee the performance of those third-party services or approve or disapprove of any content created by them.

You agree that we may exchange information and data with such third parties services regarding you, your devices and your use of the SECURAM Technology, including personal information. We may do this in order to ensure the proper functioning of the SECURAM Technology.

6. Use of SECURAM Technology

The SECURAM Technology is provided for your personal use only. You agree to use the SECURAM Technology only for lawful purposes, and in a way that does not infringe the rights of or restrict or inhibit anyone else's use and enjoyment of the SECURAM Technology.

You agree not to do any of the following (including explicit and/or imply):

A. Post, upload, publish, submit or transmit any content via the SECURAM Services, other than in connection with your personal use of the SECURAM Technology;

B. Use display, mirror or frame the SECURAM Website or any SECURAM trademark, logo, content or other proprietary information, without SECURAM's express written consent;

C. Use the SECURAM Technology in any manner that, in our sole judgment, interferes with any user's experience or the reliability, speed, or operation of the SECURAM Technology;

D. Use the SECURAM Technology in any manner that, in our sole judgment, breaches any applicable law, regulation or private legal obligation;

E. Access, tamper with, or use non-public areas of the Licensed Software, SECURAM Services,SECURAM's computer systems, or the technical delivery systems of SECURAM's providers, or attempt to do so;

F. Attempt to probe, scan, or test the vulnerability of the SECURAM Technology, system or network or breach any security or authentication measures, or to reverse engineer, decompile or otherwise attempt to gain the source code for any SECURAM Technology;

G. Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by SECURAM or any of SECURAM's providers or any other third-party (including another user) in connection with the SECURAM Technology;

H. Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;

I. Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the service;

J. Use the SECURAM Technology to collect or store any personally identifiable information from other users of the service without their express permission;

K. Use the Licensed Software or SECURAM Services to impersonate any person or send altered, deceptive or false source-identifying information, or misrepresent your affiliation with any person or entity; or

L. Violate any applicable law or regulation.

Although we're not obligated to monitor your access to or use of the SECURAM Technology or to review or edit any content, we have the right to do so, for the purpose of operating the SECURAM Technology, to ensure compliance with these Terms, and to comply with applicable law. We reserve the right, but are not obligated, to remove or disable access to the SECURAM Technology or any content therein, at any time and without notice, in order to accomplish the foregoing. We have the right to investigate violations of these Terms or conduct that affects the Service. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

7. System Requirements

To use the SECURAM Technology, you must have:

A. A working Wi-Fi network in your location that is positioned to communicate reliably with the SECURAM Devices (certain SECURAM Services may work without Wi-Fi);

B. A valid user account;

C. For mobile clients, an adequate mobile device, such as a supported phone, tablet or watch (required for some functionality), connected to a mobile network;

D. Always-on broadband Internet access in your location; and

E. Other system elements that may be specified by SECURAM.

It is your responsibility to ensure that you have all required system elements and that they are compatible, up to date, and properly configured. You acknowledge that the SECURAM Services may not work as described without the foregoing.

8. Open Source

The SECURAM Services may contain or be distributed with open source software which may be covered by a different license. You agree that all open source software shall be and shall remain subject to the terms and conditions under which it is provided, and you shall be responsible for compliance with such terms.

9. Feedback

We appreciate it when users send us feedback. By submitting any information or suggestions to us, you grant us an unlimited, transferable right to use your feedback, information and suggestions.

10. Effectiveness and Termination of Terms; Service Changes

These Terms will be effective once you give your consent, which you may do by clicking "I Agree" when you register a user account, or by your other communications or conduct. By accessing and continuing to use the SECURAM Technology, you will be understood as having agreed to and accepted these Terms. These Terms will remain in effect until the termination of your use of the SECURAM Technology.

You may terminate the SECURAM Services at any time, by sending your termination request to info@easthouse.net. SECURAM reserves the right to suspend or terminate your use of the SECURAM Services at any time, with or without cause or notice, in our sole discretion. Your obligations under sections 3, 4, 5, 6, 10, 22, and 13 will survive the termination of your relationship with us.

11. Warranties and Disclaimers

The warranties for the SECURAM Technology are set forth in the SECURAM Smart Home Privacy Policy, SECURAM Smart Home End User License Agreement, Operation Instructions, SECURAM Smart Home Limited Warranty and other related documents.

It is your responsibility to select the SECURAM Devices that best meet your requirements and that will be compatible with your home network, computer and mobile device. THE SECURAM TECHNOLOGY IS PROVIDED FOR YOUR CONVENIENCE, "AS IS" AND "AS AVAILABLE." SECURAM AND ITS AFFILIATES, LICENSORS AND SUPPLIERS EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

The SECURAM Technology relies on third party products and services, such as those that supply Internet and Wi-Fi access in your location. These third party products and services are beyond SECURAM's control, but their operation may impact or be impacted by the use and reliability of the SECURAM Technology.YOU ACKNOWLEDGE THESE LIMITATIONS AND AGREE THAT SECURAM IS NOT RESPONSIBLE FOR ANY DAMAGES AND LOSSES ARISING FROM OR RELATED TO THE OPERATION OR FAILURE OF THESE THIRD PARTY PRODUCTS AND SERVICES, INCLUDING ANY FAILURE OR DELAY OF THE SECURAM TECHNOLOGY TO REFLECT CURRENT STATUS OR NOTIFICATIONS.

SECURAM does not guarantee or assume responsibility for any third party website or service hyperlinked or referred to in the SECURAM Website.

Although the SECURAM Website is accessible worldwide, the SECURAM Technology may not work in all areas.SECURAM IS NOT RESPONSIBLE TO ANY LOSS, HARM OR DISPUTE CAUSED BY OR RELATED TO CONDITIONS OR LIMITATIONS SPECIFIC TO YOUR LOCATION.

12. Emergency Notification

The SECURAM Technology is not an emergency notification system, and should not be used in this way. SECURAM is not responsible for dispatching any emergency services to your home. IN THE EVENT OF AN EMERGENCY, PLEASE CONTACT THE APPROPRIATE AUTHORITIES AND EMERGENCY RESPONDERS IMMEDIATELY.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SECURAM, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS, BE LIABLE FOR AND ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL (INCLUDING LOSS OF USE, DATA, BUSINESS, OR PROFITS) CAUSED BY OR RELATED TO:

A. THE FUNCTIONING OF THE SECURAM TECHNOLOGY, REGARDLESS OF LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN WARNED, KNEW OR SHOULD HAVE KNOWN, OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE;

B. NORMAL WEAR AND TEAR OR AGING;

C. IMPROPER REPAIR OR MAINTENANCE, INCLUDING ATTEMPTED REPAIR BY ANYONE OTHER THAN A PERSON AUTHORIZED BY SECURAM TO SERVICE YOUR SECURAM DEVICES; OR

D. AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SECURAM TECHNOLOGY MORE THAN THE GREATER OF $100, OR THE AMOUNTS PAID BY YOU TO US FOR THE PAST TWELVE MONTHS OF THE SERVICES IN QUESTION. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM.

Some states do not allow the types of limitations in this paragraph, so they may not apply to you. Nothing in these Terms and in particular within this section shall attempt to exclude liability that cannot be excluded under applicable law.

SECURAM SmartBolt is NOT a door lock. It must be correctly installed and used with a certified and reliable door lock that is operating in good condition. You assume all risk associated with the suitability, installation and performance of the door lock and other third party components, hardware, software and services.

SECURAM makes no representations concerning any content contained in or accessed through the SECURAM Technology, and SECURAM will not be responsible or liable for the accuracy or legality of material created by third parties. SECURAM makes no representations or warranties regarding third-party services or products.

14. Downloading the Application

You must download or install the SECURAM Smart Home application through the Apple Store or Google Play. SECURAM is not responsible for any loss, damage or dispute caused by or related to an application downloaded or installed from an application provider other than the Apple Store or Google Play.

These Terms constitute a legal agreement involving you and SECURAM, not the application provider. SECURAM is not responsible for any act or omission by the application provider. In the event of any failure of the application to perform as designed, you may wish to contact the application provider.

In the event of any third party claim that the application or your possession or use of that application infringes that third party's intellectual property rights, as between application provider and SECURAM, SECURAM will be solely responsible for the investigation, defense, settlement and discharge of any such claim to the extent required by these Terms.

15. Modification

Our employees are not authorized to vary these Terms. These Terms may be modified only by SECURAM, acting through a duly authorized officer of SECURAM. SECURAM may modify these Terms from time to time, and your right to access the SECURAM Technology is conditioned on your ongoing compliance with the then-current version of these Terms.

We will notify you when we make material revisions or modifications to these Terms by:

A.posting a notice or new version of these Terms on the SECURAM Website; or

B.providing direct notice in a communication to your customer account (if you have one), or otherwise in some manner that we deem reasonably likely to reach you (such as by posting to social media channels).

The modifications will be effective upon posting (unless otherwise indicated at the time of posting). By continuing to access and use the SECURAM Technology after revisions to these Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the SECURAM Technology forthwith.

16. Ownership

SECURAM (or its affiliates or licensors) are the owner of all right, title and interest in and to the SECURAM Technology. We reserve all rights not expressly granted in these Terms. All SECURAM Services and Licensed Software are licensed and not sold.

17. Entire Agreement

These Terms constitute the entire agreement between you and SECURAM regarding the use of the SECURAM Technology. Any failure by SECURAM to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. Neither party is an agent or partner of the other party. The headings and section titles in these Terms are for convenience only and have no legal or contractual effect.

18. Force Majeure

SECURAM shall not be liable for failing or delaying performance of its obligations resulting from any condition beyond its reasonable control, including but not limited to, governmental action, acts of terrorism, natural disasters, earthquake, fire, flood or other acts of God, labor conditions, power failures, and disruption of Internet service.

19. Notifications

SECURAM may provide notifications to you as required by law or for marketing or other purposes via (at its option) email to the primary email associated with your account, hard copy, or posting of such notice on the Site or Service. SECURAM is not responsible for any automatic filtering you or your network provider may apply to email notifications.

If you are a California resident, then in accordance with Cal. Civ. Code § 1789.3, you may report any complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 400 R Street, Sacramento, CA 95814, or by telephone at 1-800-952-5210.

20. Assignment

These Terms, and any associated rights or obligations, may not be assigned or otherwise transferred by you without SECURAM's prior written consent, and shall be null and void. These Terms may be assigned by SECURAM without restriction. These Terms are binding upon any permitted assignee.

21. California Law and Venue, Waiver of Right to File Representative Action

These Terms shall be construed in accordance with and governed by the laws of the United States and the State of California, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the Superior Court of Ventura County, California, and to the federal courts of the Central District of California, in all disputes arising from or related to the use of the SECURAM Technology. All claims subject to these Terms shall be conducted on an individual basis, and not as a class or collective action, and you waive the right to participate in any such action.
